15. Disclaimer of Liability and Insurance

15.1. A boat is entirely responsible for its own safety, whether a?oat or ashore, and nothing, whether in the Notice of Race or Sailing Instructions or anywhere else, reduces this responsibility.

15.2. It is for the boat to decide whether it is ? t to sail in the conditions in which it will ?nd itself. By launching or going to sea, the boat con?rms that it is ?t for those conditions and that its crew is competent to sail and compete in them.

15.3. The boat is required to hold adequate insurance and in particular to hold insurance against third party claims in the sum of at least £2m.

15.4. Nothing done by the organisers will reduce the responsibility of the boat nor will it make the organisers responsible for any loss, damage, death or personal injury, however it may have occurred, as a result of the boat taking part in the racing. The organisers encompass everyone helping to run the race and the event, and include the organising authority, the race committee, the race of?cer, patrol boats and beachmasters.

15.5. The provision of patrol boats does not relieve the boat of its responsibilities.

15.6. Although reasonable efforts will be made to provide patrol boat cover, competitors are reminded that, particularly in extreme weather conditions, cover should not be relied upon, and in any event they can only be given such assistance as can be practically provided in the circumstances. This is particularly relevant in winter and spring sailing where the risk of hypothermia is at its highest.
